1. Acceptance
These Terms of Service (“Terms”) form a binding agreement between you and the individual who operates MogMap (the “operator of MogMap,” “we,” “us,” or “our”). By creating an account, signing in, or using the MogMap web app or progressive web app (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the involvement of, and permission from, a parent or legal guardian. The Service is not directed to children under 13.
You represent that you are not located in, under the control of, or a national or resident of any country or territory subject to U.S. comprehensive sanctions, and that you are not on any U.S. government restricted-party list.
3. Your account
You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at mogmap.app@gmail.com if you suspect unauthorized use.
4. Acceptable use
You agree not to:
- Upload photographs of any person other than yourself, or of anyone without their explicit consent. If you are a minor, you may only upload photographs of your own face.
- Upload any child sexual abuse material (CSAM) or any sexual content depicting a minor. We will report suspected CSAM to the National Center for Missing & Exploited Children as required by 18 U.S.C. § 2258A and preserve related account data for law-enforcement review.
- Upload obscene, illegal, hateful, or otherwise objectionable content, including in your username, bio, or avatar.
- Harass, threaten, dox, impersonate, or defame any other user.
- Attempt to bypass authentication, row-level security, signed URLs, rate limits, or other protective measures.
- Scrape, mirror, or otherwise copy the Service or its data at scale, or use automated agents except via interfaces we explicitly publish. You may not use the Service or its outputs to build, train, or evaluate a competing product, dataset, or machine-learning model.
- Reverse engineer the Service except where such restriction is prohibited by applicable law.
- Use the Service to violate any law or third-party right.
5. User content & license
You retain ownership of the photos, bio text, username, and other content you submit (“User Content”). You grant MogMap a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely to operate, secure, and improve the Service. This license terminates when you delete the User Content or your account, except that (a) short-lived encrypted backups may persist for a limited rotation period, and (b) we may retain de-identified, aggregated statistics that cannot reasonably be used to re-identify you.
You acknowledge that, by default, the following content is shown to every other signed-in MogMap user through leaderboards, search, and your public profile page: your username, avatar, bio, city/state/country, best tier (when enabled — default on), best numeric score (when enabled — default off), and the lists of accounts you follow and that follow you. You can change these visibility settings at any time in Settings → Leaderboard Visibility. Your raw scan photos are never shown to other users.
6. AI-generated output
Scores, tiers, “softmax” / “hardmax” recommendations, peptide notes, and any other output from MogMap are produced by an AI model and are inherently approximate. They are provided for entertainment and personal self-improvement only, are not medical, psychological, dating, or hiring advice, and must not be relied upon for any decision with health, financial, legal, or safety consequences. Always consult a qualified professional before starting, stopping, or changing any medical, surgical, or pharmacological intervention. Mention of peptides, prescription drugs, or surgical procedures is informational only and is not a prescription or an endorsement.
7. Termination
You may stop using the Service and delete your account at any time from the Settings screen. We may suspend or terminate your access if you violate these Terms, abuse the Service, or create risk for us or other users. Sections that by their nature should survive termination (including Sections 5, 8, 9, 10, 11, 12, and 14) will survive.
If we terminate your account for cause (e.g. violation of Section 4), any remaining paid scan credits — including MogMap Pro credits and Scan Pack credits — are forfeited without refund. If you voluntarily delete your account, remaining paid credits are likewise forfeited without refund.
8. Paid scans, expiration & no refunds
The free tier includes 2 lifetime scans per account. MogMap Pro is $4.99/month for 8 scans per month that stack across billing periods. A one-time Scan Pack is also available for $2.50 and grants 2 scans that never expire.
Each Pro grant of 8 scans expires 90 days after the date it was granted, regardless of subscription status. Scan Pack scans never expire. Expired Pro scans are permanently revoked and non-refundable. Cancelling Pro stops future grants but does not change the 90-day expiry of Pro scans already granted.
All purchases are non-refundable and non-transferable, except where a refund is required by applicable law. See the Privacy Policy for the full billing terms; by subscribing you agree to them. Billing is handled by Stripe.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOGMAP AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for gross negligence, fraud, willful misconduct, or statutory consumer-protection rights that cannot be waived).
11. Indemnification
You agree to indemnify, defend, and hold MogMap and its operator harmless from any claim, demand, damages, or expense (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
12. Governing law, informal resolution & binding arbitration
Governing law. These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-laws principles.
Informal resolution first. Before starting an arbitration or small-claims action, you agree to first email mogmap.app@gmail.com with a description of the dispute and the relief you seek, and to give us at least 30 days to try to resolve it informally.
Binding individual arbitration. If the dispute is not resolved informally, you and the operator of MogMap agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration is Florida; the arbitration may be conducted by telephone, video, or written submissions unless the arbitrator orders otherwise. Judgment on the award may be entered in any court of competent jurisdiction. Either party may bring an individual action in small-claims court for disputes within that court’s jurisdiction instead of arbitration.
Class-action waiver. You and the operator of MogMap each waive any right to bring or participate in a class, representative, collective, or private-attorney-general action. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.
30-day opt-out. You may opt out of this arbitration agreement by emailing mogmap.app@gmail.com within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and your account email in the body. Opting out does not affect any other provision of these Terms.
Severability. If the class-action waiver is found unenforceable as to a particular claim or remedy, that claim or remedy — and only that claim or remedy — will be severed and litigated in the state or federal courts located in Florida, and the remainder of this Section will remain in full force. If any other provision of this Section is found unenforceable, the remaining provisions will remain in effect.
Venue for non-arbitrable claims. For any claim not subject to arbitration, exclusive venue lies in the state and federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
13. DMCA / copyright complaints
We respect intellectual property rights. If you believe content on MogMap infringes your copyright, send a written notice containing the information required by 17 U.S.C. § 512(c)(3) (identification of the work, identification of the material, your contact information, a statement of good-faith belief, a statement under penalty of perjury that the information is accurate and you are authorized to act, and your physical or electronic signature) to our designated agent at mogmap.app@gmail.com with the subject line “DMCA Notice.” We may terminate the accounts of repeat infringers.
14. Electronic notices
You consent to receive communications from us electronically, including by email to the address associated with your account and by in-app notices. Legal notices to you are effective when sent to your account email or posted in the Service.
15. Miscellaneous
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and the operator of MogMap regarding the Service and supersede any prior agreements.
Severability. If any provision is held unenforceable, the remaining provisions will remain in full force.
No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
16. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, prompt you to re-accept the Terms inside the app before continuing to use the Service.
